Terms of Service

StorPod is a global community which enables people who have additional space they wish to rent out (the "Landlord") to connect with people who need and are willing to pay to hire additional space (the "Tenant") convenient to them and at a fair price. It provides the opportunity for people with rentable space to realise supplementary income and Tenants an alternative to using traditional self-storage facilities which can often be inconvenient or costly.

By using the StorPod.com Website ("Website" or "Site"), a service of Got2HaveYou Limited (the "Company", registered in England and Wales with company registration number 06502818), you are agreeing to be bound by the following terms and conditions ("Terms of Service"). You must read the following Terms of Service and comply with them at all times. If you register for a membership with us, you will be required to check a box at the point of registration which means that you have read, understood and accepted these Terms of Service. If you do not agree with the Terms of Service, you must leave the Website and not use it at all.

 

Basic Terms

  1. You must be 13 years or older to use this Website. If you are using our Site as a business entity you warrant that you (as the registrant and user) are over 13 years old and otherwise eligible to use this Site.
  2. You are responsible for any activity that occurs under your profile name.
  3. You are responsible for keeping your password secure.
  4. You may not use the StorPod service for any illegal or unauthorised purpose. Users outside the UK agree to comply with all local laws regarding online conduct and acceptable content.
  5. You are solely responsible for your conduct and any data, text, information, screen names, graphics, photos, profiles, audio and video clips, links ("Content") that you submit, post, and display on the StorPod service. You agree that the information you supply to us is accurate and that you will keep it current.
  6. You must not modify, adapt or hack StorPod or modify another website so as to falsely imply that it is associated with StorPod.
  7. You must not, in the use of StorPod, violate any laws in your jurisdiction (including but not limited to copyright laws).
  8. You must not, in the use of StorPod, impersonate any other person or submit content on behalf of any other person or entity without their express permission (such as when you are acting as an agent).
  9. You must not submit content which
    • infringes on the intellectual property rights or other rights of a person or entity;
    • intentionally interferes with the Site’s operation;
    • violates any person’s privacy or public rights or breaches any duty of confidentiality that you owe to anyone or provides any non-public information about StorPod or any other company or person without authorisation;
    • is harassing, defamatory, abusive, pornographic, obscene or otherwise objectionable (in our sole judgment);
    • contains or installs any viruses, worms, bugs, Trojan horses or other code, files or programs designed to, or capable of, disrupting, damaging or limiting the functionality of any software or hardware;
    • contains false or deceptive language, unsubstantiated or comparative claims regarding our or others’ products, third party advertising, spam, chain letters, or any other solicitation, including solicitation of lawsuits. Links that connect to commercial websites will not be considered unauthorised solicitations unless the link or the website content appears to be intended as a means of solicitation or part of an "affiliate" program as determined by StorPod in its sole discretion; or
    • creates liability for the Company or cause us to lose (in whole or in part) the services of our ISPs or other suppliers.
  10. StorPod is a service which was founded and developed in the UK. Whilst we welcome global usage of the Site, StorPod makes no representation that it is fit for use in countries outside the UK.


Violation of any of these agreements will result in the termination of your StorPod account. While StrorPod prohibits certain types of conduct and content on its Site (as described herein), you understand and agree that StorPod cannot be responsible for the Content posted on its Website and you nonetheless may be exposed to such materials and that you use the StorPod service at your own risk.

 

General Conditions

  1. Use of the StorPod service is entirely at your risk. We provide an introductory service between Tenants and Landlords and charge for this service. You agree that all information on the Site is provided "As Is" and that we do not warrant any of the content posted by our users. All Users, whether rental space owners or rental space users hereby release the Website, the Company and its officers, directors, agents, affiliates, parents, subsidiaries, investors and employees from all claims, liability, demands, damages (actual, special, direct, indirect and consequential), losses, costs and expenses, all legal fees, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with any arrangements the User may have made.
  2. The User is wholly responsible for completing all transactions participated in (including but not limited to monitoring the status and complying with all relevant legal and taxation obligations). The Website does not control, endorse, approve or check the availability of the rental space or accuracy of the information provided regarding the available spaces listed through the Website. You may find other Users' information to be offensive, harmful, inaccurate, or deceptive. Please use caution, common sense, and practice safe trading when using the Website. Please note that there are also risks of dealing with underage persons or people acting under false pretence.
  3. For the avoidance of doubt it is hereby made clear that the Company does not control the information provided by other Users, which is made available through the Website.
  4. The Company does not accept liability for any loss or damage of any nature arising directly or indirectly as a result of any User acting or refraining from acting as a result of using either the various precedent rental agreements provided on the Website from time to time.
  5. The Landlord must be legally permitted to advertise the rental space(s) they represent on the Website. It is the responsibility of the User to investigate the legality of licensing the rental space. Membership payment to StorPod is final and no refunds will be issued should a Landlord subsequently be unable to rent a given property although they may remove the property from their profile.
  6. We reserve the right to modify or terminate the StorPod service for any reason, without notice at any time.
  7. We reserve the right to alter these Terms of Service at any time. If the alterations constitute a material change to the Terms of Service, we will notify you via internet mail according to the preference expressed on your account. What constitutes a "material change" will be determined at our sole discretion, in good faith and using common sense and reasonable judgement.
  8. We reserve the right, in accordance with any applicable laws, to refuse service to anyone for any reason at any time.
  9. While we do not generally pre-screen content posted by Site users, we may, but have no obligation to, remove Content and accounts containing Content that we determine in our sole discretion are unlawful, offensive, threatening, libellous, defamatory, obscene or otherwise objectionable or violates any party's intellectual property or these Terms of Service.
  10. The StorPod service makes it possible to post images and text hosted on StorPod to outside websites. This use is accepted. However, pages on other websites which display data hosted on StorPod must provide a link back to StorPod.
  11. We reserve the right to reclaim usernames on behalf of businesses or individuals that hold legal claim or trademark on those usernames.
  12. StorPod functions on the basis of having useful, updated information for users. We reserve the right to suspend or terminate your account if we have reasonable grounds to suspect that your information is inaccurate.
  13. You also agree that we are free to use any of the Materials or any comments, information or ideas contained in any content or communication you submit to us or the Site, without notice, compensation or acknowledgement to you, for any purpose whatsoever, including but not limited to advertising and marketing, modifying the Site and developing products and services.
  14. By listing a property at a specified price, you are making a legal offer. By accepting as a Tenant at the advertised (or some other mutually negotiated) price for a property for the term agreed you are accepting those conditions, and a legal contract is formed. Neither party has the right to alter the agreed price after this point.

 

Copyright and Modification

  1. The StorPod Website, text, logos, engine, marketing materials and related information is owned by the Company and protected globally.
  2. StorPod may modify the Site at any time and for any reason and does not require giving you notice of any changes.
  3. We claim no intellectual property rights over the material you provide to the StorPod service. Your profile and materials uploaded remain yours, which you must govern according to the conditions described in these Terms of Service. You can disable your profile at any time and delete photos from your account.
  4. The Site may include links to third party sites, which are not under StorPod’s control and have their own Copyright and Terms of Service statements. You access them at your own risk.
  5. StorPod undertakes to obey all relevant copyright laws. We will review all claims of copyright infringement received and remove content deemed to have been posted or distributed in violation of any such laws. To make a claim, please provide us with the following:
    1. A physical or electronic signature of the copyright owner or the person authorised to act on its behalf;
    2. A description of the copyrighted work claimed to have been infringed;
    3. A description of the infringing material and information reasonably sufficient to permit StorPod to locate the material;
    4. Your contact information, including your address, telephone number (including relevant international dialling codes), and email;
    5. A statement by you that you have a good faith belief that use of the material in the manner complained of is not authorised by the copyright owner, its agent, or the law; and
    6. A statement that the information in the notification is accurate, and, under the pains and penalties of perjury, that you are authorised to act on behalf of the copyright owner.

 

Governing Law

These Terms and Conditions (together with all documents referred to in them) are governed by and construed in accordance with English law. The parties irrevocably agree that the English courts have non-exclusive jurisdiction to settle any dispute or claim that arises out of or in connection with the Terms and Conditions or any documents referred to in them.

 

The User’s Use of Other Users' Information

As a means to facilitate the licensing of available space, the Company permits the User limited access to other Users' contact information contained on the Website. By accepting these Terms and Conditions, the User agrees that, with respect to other Users' personally identifiable information that you obtain through the Website or through a Website communication or Website facilitated transaction; you may only use such information for:

  1. Website related communications that are not unsolicited commercial messages and relate to your genuine participation in a Website facilitated transaction;
  2. using services offered through the Website (e.g. escrow, insurance, postal and fraud complaints);
  3. any other purpose that such user expressly agrees to after adequate disclosure of the purpose(s). In addition, you shall only use such information in accordance with applicable laws and regulations, including without limitation data protection and privacy laws. In all cases, you must give users an opportunity to remove themselves from your database and a chance to review what information you have collected about them. In addition, under no circumstances, can you disclose personally identifiable information about another User to any third party without our consent and the consent of such other user after adequate disclosure, and

The Company does not tolerate spam or unsolicited commercial communications and Users shall not make unsolicited contact by those or similar means.

 

No Warranty

The Company does not guarantee continuous, uninterrupted or secure access to the Website, and the Website may be interfered with factors outside the control of the Company. To the fullest extent permitted by law the Company excludes all implied warranties, conditions and other terms, whether implied or by statute or otherwise, including without limitation any terms as to skill and care or timeliness of performance. This may not apply to Users in certain jurisdictions that do not allow the disclaimer of implied warranties.

 

Entire Agreement

These Terms and Conditions and the other documents entered into contemporaneously with or pursuant to them, constitutes the entire agreement and understanding between the parties and supersedes any previous agreement or understanding between the parties with respect to all matters referred to in them.

 

Fees

Running searches on StorPod and registering for a user account is completely free of charge, however Landlords who wish to list a space must pay a fee at the prescribed rates. Making an offer and communicating between members is also free of charge. In all cases you will remain responsible for the costs of accessing and using the Site (internet access, electricity, etc.).

Unless otherwise stated, all fees are quoted in GB pounds sterling. If you wish to list a property to be available for rent, you are responsible for paying all fees and applicable taxes associated with using our Site prior to making such listings.

The listing fee you pay is valid for a year (365 continuous days) from the point of payment. To continue listings on StorPod at the end of that year and on every anniversary thereafter, you will be required to pay the then-current membership fees. If you do not pay, you will not be able to list your property, although you may continue to have access to the Site providing your account is otherwise in good standing with us.

If you disable your account during a year for which you have already paid you will not be eligible for any service credits during the period your account is disabled. If you re-enable your account following the end of the year for which you had previously paid, you will be required to pay a subscription renewal at the prescribed rates.

If we terminate your account you will not be eligible for any refunds.

 

Termination

We may terminate your account for reasons listed herein. You may also terminate your account by requesting it be disabled and following the appropriate procedures within your account. In the latter case, you will be eligible to reactivate your account at any time.

 

Offline Bookings

StorPod prefers you to secure bookings online, in the spirit of the Website and as we do not charge a fee based on the value of your booking, we prefer if your Tenant registers with us to conclude your booking through the Website.

Offline bookings (i.e. those made outside of the StorPod system) are permitted but should you conclude a booking for a property you have listed in StorPod you are required to then amend the availability of that property to reflect its actual status. You will not be eligible for any refunds paid for service.

 

Devices

You agree that you will not use any robot, spider, other automatic device, or manual process to monitor or copy our Web pages or the content contained herein without our prior expressed written permission. You agree that you will not use any device, software or routine to interfere or attempt to interfere with the proper working of the StorPod Website or any listing, offer or transaction being conducted on our Site. You agree that you will not take any action that imposes an unreasonable or disproportionately large load on our infrastructure.

 

Limitation on Liability

Neither StorPod nor any of its directors, employees, agents or suppliers will be liable for any direct, indirect, special, punitive, consequential or incidental damages including, without limitation, lost profits or revenues, costs of replacement goods, loss or damage to data arising out of the use or inability to use this Website or any StorPod product, or damages from the use of or reliance on the information present on this Website, even if StorPod has been advised of the possibility of such damages.

 

Services Not Provided

In connection with your use of StorPod’s Website and/or services, you acknowledge and agree as follows:

  1. StorPod does not participate in any actual lease transactions, including, without limitation, negotiations, discussions, or proposals;
  2. StorPod does not render legal, brokerage, or other professional advice or services;
  3. StorPod is not undertaking any, and has no, fiduciary duties to either Landlords or Tenant, including, without limitation, the obligation to inspect rental properties or to verify the veracity of information contained in a preview of your property or Offers;
  4. StorPod is not responsible for the content of, nor does it endorse, the third party websites to which you may link using this Website;
  5. StorPod does not guarantee the accuracy of any information available on this Website, and is not responsible for any errors, omissions, or misrepresentations, whether made by Landlords, Tenant or otherwise and all information obtained on this Website or from Owners must be verified independently;
  6. StorPod may make changes to its products and/or services and this Website at any time and without notifying you or receiving your consent; and while StorPod complies with UK civil rights laws, StorPod does not monitor transmissions of information by Landlords and Tenants and thus assumes no liability for Tenants' and/or Landlords' failures to comply with such laws.
